Terms of Service

Welcome to PropertyHub Kenya. These Terms of Service (“Terms”) govern your access to and use of the PropertyHub Kenya website, services, and platform (collectively referred to as “the Platform”). By accessing, registering, or using the Platform, you agree to comply with and be legally bound by these Terms. If you do not agree with these Terms, you must not use the Platform.

1. Eligibility

To use PropertyHub Kenya, you must:

• Be at least 18 years of age
• Have the legal capacity to enter binding contracts under the laws of Kenya
• Provide accurate and truthful information

By using the Platform, you represent and warrant that you meet these requirements.

2. Nature of the Platform

PropertyHub Kenya operates solely as a digital marketplace connecting property buyers, sellers, landlords, tenants, and real estate agents. PropertyHub Kenya:

• Does not own, sell, rent, or manage properties listed
• Does not act as a real estate broker or agent
• Does not guarantee the accuracy, legality, or availability of listings

All transactions, negotiations, and agreements occur solely between users. Users are advised to perform independent due diligence before entering into any property transaction.

3. User Accounts

To access certain features, users must create an account. You agree that:

• All information provided during registration is accurate and current
• You will maintain the security of your login credentials
• You are responsible for all activity under your account

PropertyHub Kenya reserves the right to suspend or terminate accounts, remove listings, or restrict access if any activity is deemed suspicious, fraudulent, or in violation of these Terms.

4. Property Listings

Only property owners, developers, or authorized real estate agents may post listings. By posting a listing, you confirm that:

• You have legal authority to advertise the property
• All listing information is accurate and truthful
• The listing does not infringe on any third-party rights

Listings must not contain false pricing, fake properties, misleading images, or copyright-infringing material. PropertyHub Kenya reserves the right to edit, suspend, or remove listings or verify authorization without prior notice.

Free and paid plans may include listing limits or restrictions, which may change at any time.

5. Verification and Due Diligence

PropertyHub Kenya may provide optional verification services for agents or listings, but such verification does not guarantee legitimacy or constitute endorsement. Users must independently verify property ownership, legal documentation, title deeds, and agency authority.

PropertyHub Kenya shall not be responsible for fraudulent listings or misrepresentation by users.

6. Prohibited Conduct

Users agree not to:

• Post fraudulent or misleading property listings
• Use the platform for scams or deceptive activities
• Upload copyright-protected material without permission
• Scrape, harvest, copy, or extract data from the platform
• Attempt to hack, disrupt, or interfere with the system
• Harass, threaten, or abuse other users
• Circumvent payment systems or subscription rules

Violation may result in immediate account suspension, permanent ban, or legal action.

7. Intellectual Property

All intellectual property on the Platform, including logos, design, software, databases, content, and branding, is owned by PropertyHub Kenya or its licensors. Users may not reproduce, copy, distribute, or modify any part of the platform without prior written permission.

8. Payments and Subscriptions

Some features may require payment, including premium listings, agent subscriptions, and advertising services. By purchasing any paid service, you agree to the published pricing and that payments are non-refundable unless otherwise stated.

PropertyHub Kenya reserves the right to modify pricing, introduce new paid features, or change subscription plans with reasonable notice.

9. Third-Party Services

The Platform may contain links to third-party websites, services, or advertisements. PropertyHub Kenya does not control these services and is not responsible for their content, services, or transactions.

10. Limitation of Liability

To the fullest extent permitted under Kenyan law, PropertyHub Kenya shall not be liable for fraudulent listings, misrepresentation by users, property disputes, loss of money, failed property deals, or indirect damages. The Platform is provided “as is” and use is at the user’s own risk.

11. Indemnification

You agree to indemnify PropertyHub Kenya, its directors, and employees from any claims, damages, or legal expenses arising from your use of the Platform, your listings, violations of these Terms, or disputes between users.

12. Suspension and Termination

PropertyHub Kenya may suspend or terminate accounts if users violate these Terms, post fraudulent listings, or abuse the platform. Termination may occur without prior notice.

13. Data Protection and Privacy

PropertyHub Kenya processes user data in accordance with the Kenya Data Protection Act and applicable Kenyan privacy laws. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

14. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Kenya. Any disputes shall be resolved exclusively in the courts located in Nairobi.

15. Changes to These Terms

PropertyHub Kenya reserves the right to modify these Terms at any time. Users will be notified through email, platform notifications, or website updates. Continued use after updates constitutes acceptance.
